Agreement to Terms
Welcome to CruizeMakers. These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “user”) and CruizeMakers (“we,” “us,” “our,” or “CruizeMakers”) governing your access to and use of the CruizeMakers website located at www.cruizemakers.com (the “Website”) and all related services, features, content, and applications offered by CruizeMakers (collectively, the “Services”).
By accessing, browsing, or using our Website or Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use our Website or Services.
Service Description
CruizeMakers operates as a cruise booking support helpdesk providing assistance, information, and support services related to cruise vacation planning and bookings. Our Services include but are not limited to: consultation regarding cruise options and itineraries, assistance with cruise reservations and bookings, support for managing existing cruise reservations, information about cruise lines, ships, destinations, and policies, and general cruise travel guidance.
CruizeMakers acts as an intermediary support service connecting travelers with cruise lines and related travel service providers. We do not own, operate, or control cruise ships, airlines, hotels, or other travel suppliers. Our role is facilitating bookings and providing support services rather than operating as the direct provider of travel services.
Eligibility and Account Registration
To use certain features of our Services, you must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. By using our Services, you represent and warrant that you meet these age requirements and have the legal capacity to enter into binding contracts.
When creating an account, you agree to provide accurate, current, and complete information and to maintain and update this information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.
User Obligations and Prohibited Conduct
When using our Services, you agree to comply with all applicable laws, regulations, and these Terms. You specifically agree not to:
Provide false, inaccurate, or misleading information to CruizeMakers, cruise lines, or other service providers; use our Services for any illegal, harmful, fraudulent, or unauthorized purpose; attempt to interfere with, compromise, or disrupt the integrity or performance of our Website or Services; access or attempt to access accounts, systems, or networks not intended for you; transmit viruses, malware, or other harmful code; harvest, scrape, or collect information about other users without authorization; impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity; violate any intellectual property rights of CruizeMakers or third parties; post or transmit offensive, defamatory, obscene, or otherwise objectionable content; or engage in any activity that could damage CruizeMakers’ reputation or relationships with cruise lines and partners.
Booking Process and Reservations
When you request assistance with cruise bookings through our Services, you understand and agree that:
Pricing and Availability: Cruise prices, availability, and promotional offers are subject to change without notice until a booking is confirmed and payment is processed. We strive to provide accurate pricing information but cannot guarantee absolute accuracy due to the dynamic nature of cruise inventory and pricing systems.
Payment and Deposits: Cruise bookings typically require deposits and full payment according to cruise line policies and payment schedules. You are responsible for providing valid payment information and ensuring sufficient funds or credit availability for required payments.
Booking Confirmation: A cruise booking is not confirmed until you receive written confirmation from CruizeMakers or directly from the cruise line. Verbal discussions, quotes, or preliminary reservations do not constitute confirmed bookings.
Personal Information Accuracy: You are responsible for providing accurate personal information including legal names as they appear on government-issued identification documents, dates of birth, passport information, and other details required by cruise lines. Errors in passenger information may result in denied boarding, additional fees, or booking cancellations, for which you bear responsibility.
Cruise Line Terms: All cruise bookings are subject to the terms, conditions, and policies of the applicable cruise line including ticket contracts, cancellation policies, and passenger conduct rules. You are responsible for reviewing and understanding cruise line terms before confirming bookings.
Cancellations, Changes, and Refunds
Cancellations, changes, and refunds for cruise bookings are governed by the specific policies of the cruise line and other service providers involved in your arrangements. CruizeMakers will assist you in processing cancellations and changes according to applicable policies, but we do not establish these policies nor do we guarantee specific outcomes.
Cancellation Penalties: Most cruise bookings are subject to cancellation penalties that increase as departure dates approach. These penalties are established by cruise lines, and neither CruizeMakers nor you can avoid them once bookings are made. We strongly recommend purchasing travel insurance to protect against cancellation penalties.
Change Fees: Changes to confirmed bookings may incur fees charged by cruise lines and other suppliers. Some changes may not be possible depending on cruise line policies and availability. We will communicate applicable fees before processing changes when possible.
Service Fees: CruizeMakers may charge service fees for booking assistance, changes, cancellations, and other support services. These fees will be clearly disclosed before you incur them and are generally non-refundable except as specified in our Refund Policy.
Travel Documents and Requirements
You are solely responsible for obtaining and maintaining valid travel documents including passports, visas, health certificates, and any other documentation required for your cruise itinerary. Requirements vary by destination, nationality, and cruise line policies.
CruizeMakers may provide general information about documentation requirements as a courtesy, but this information is subject to change and may not be complete or current. You must verify requirements with appropriate authorities including embassy websites, cruise lines, and government agencies. Failure to obtain proper documentation may result in denied boarding without refund, for which CruizeMakers bears no responsibility.
Health, Safety, and Insurance
Cruise travel involves inherent risks including but not limited to seasickness, injuries, illnesses, weather-related incidents, and other unforeseen circumstances. You assume all risks associated with cruise travel and related activities.
You are responsible for determining whether cruise travel is appropriate given your health conditions, physical capabilities, and personal circumstances. CruizeMakers is not qualified to provide medical advice and makes no representations regarding the suitability of cruise travel for individuals with specific health conditions.
We strongly recommend purchasing comprehensive travel insurance covering trip cancellation, interruption, medical emergencies, evacuation, and other potential issues. Travel insurance can provide critical protection and financial safeguards that are not otherwise available once bookings are made.
Intellectual Property Rights
The Website and Services, including all content, features, functionality, designs, text, graphics, logos, images, software, and other materials, are owned by CruizeMakers or its licensors and are protected by intellectual property laws including copyright, trademark, patent, and trade secret laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and Services for personal, non-commercial purposes in accordance with these Terms. This license does not include any right to: reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any materials from our Website except as necessary for normal website browsing and as permitted by these Terms.
Third-Party Links and Content
Our Website and Services may contain links to third-party websites, applications, and resources including cruise line websites, travel insurance providers, and destination information sources. These links are provided for your convenience only and do not constitute endorsement, approval, or responsibility for third-party content, products, services, or practices.
When you access third-party websites, you do so at your own risk and subject to the terms and policies of those websites. CruizeMakers has no control over and assumes no responsibility for third-party content, privacy policies, or practices.
Disclaimers and Limitations of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
CRUIZEMAKERS DOES NOT WARRANT THAT THE WEBSITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION, CONTENT, OR MATERIALS PROVIDED THROUGH OUR SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, CRUIZEMAKERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO CRUIZEMAKERS IN SERVICE FEES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Indemnification
You agree to indemnify, defend, and hold harmless CruizeMakers, its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from: your use of the Website or Services; your violation of these Terms; your violation of any rights of another party; or any information you provide through the Services.
Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Fort Lauderdale, Florida, unless otherwise agreed. Each party shall bear its own costs and attorneys’ fees unless the arbitrator awards such costs and fees to the prevailing party.
YOU AND CRUIZEMAKERS AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND CRUIZEMAKERS EACH WAIVE ANY RIGHT TO A JURY TRIAL.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. To the extent arbitration does not apply, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Broward County, Florida.
Modifications to Terms
CruizeMakers reserves the right to modify these Terms at any time. We will notify users of material changes by posting updated Terms on our Website with a revised effective date and, when appropriate, by sending email notifications to registered users. Your continued use of the Website or Services after changes become effective constitutes acceptance of the modified Terms.
Termination
We reserve the right to suspend or terminate your access to the Website or Services at any time, with or without notice, for any reason including but not limited to violation of these Terms, fraudulent activity, or conduct that we determine is harmful to CruizeMakers, other users, or third parties.
Upon termination, your right to use the Website and Services immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.
General Provisions
Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of remaining provisions.
Waiver: No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
Entire Agreement: These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and CruizeMakers regarding the use of our Website and Services and supersede all prior agreements and understandings.
Assignment: You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. CruizeMakers may assign or transfer these Terms without restriction.
